What, exactly, is a defective product?

A defective product is a product that causes damage or injury to a person as a result of some defect in the product itself, its labeling or in the way that the product is used. The manufacturer or the person who sold the product to you can be held liable.

I became ill after taking an over-the-counter medication, but I haven't heard about this happening to anyone else. Could I have a case?

Although you may hear about many "class action lawsuits" involving groups of people who have been harmed by a product, it is not necessary for more than one person to be affected in order to have a case. A Robbins & Associates attorney will meet with you and listen to your story and then determine if there is liability and you are entitled to compensation for your illness.

I was in a car accident, but I'm not sure if there was something wrong with the car. Can you help?

The attorneys at Robbins & Associates have extensive experience in determining malfunction and liability. We employ expert teams who inspect and investigate autos, machinery and other apparatus to determine if there are any manufacturing defects. If you are injured in an accident we encourage you to take photos, keep notes and bring all your records and information to your consultation with one of our Atlanta, Georgia defective product attorneys.

Is there a certain amount of time that I have to file my case?

Yes. In every state there is a limited amount of time, called a statute of limitations, in which you have to file your suit. The time when the statute of limitations begins to run is usually the date of injury. Some states have what is called a delayed discovery rule where the statute of limitations does not begin to run until you discover the injury. This is important in some cases, such as where you develop cancer due to exposure to a hazardous material or you have breast implants that leak, and you do not know about it until months or years later. Your experienced defective product attorney at Robbins & Associates will explain Georgia's statue of limitations laws to you.

My husband was badly injured while using a defective power saw. The manufacturer has offered a settlement-should we take it?

Although the manufacturer may compensate your husband for his current medical costs, there may be more at stake. Will your husband be able to go back to work while he is injured? Are there other activities in which he will not be able to participate as a result of his injury? One of our experienced Atlanta, Georgia, defective product attorneys will take into consideration all the potential losses you and your family will suffer as a result of the accident and work to make sure you receive all the compensation to which you are entitled.
