Appellate Decisions

  • Medical Malpractice
    The estate of Mr. Fanning sued Grady Memorial Hospital for medical , malpractice following Mr. Fanning's undetected heart attack and death The Defendants asserted charitable immunity, and the Plaintiff had to prove at trial that Mr. Fanning was a paying patient. The Plaintiffs received a verdict for the Plaintiff, and this was appealed by the Defendants. See Fulton-DeKalb Hospital v. Fanning, 196 Ga. App.556 (1990)
  • Motorcycle Accident
    The case of estate of Brian Clark involved a motorcyclist who was slowing for a stop, and skidded out of control due to gravel and debris that had been dumped in front of the Defendant's business. The trial judge granted summary judgment for the Defendants, and the Court of Appeals reversed. There was evidence that the Defendants knew that they had dumped gravel, that it was dangerous to motorists, and that this did cause the Plaintiff to skid out of control causing severe and disabling injuries. See Clark v. Blue Circle, Inc., 237 Ga. App. 1 (1999)
  • Inadequate Security
    The Plaintiff was a resident at the Briargate Apartments, and she sued for inadequate security following her attack and rape It was established that the Defendants knew from a prior attack that there was a problem at the complex, and the Defendants did not repair a broken window in the Plaintiff's apartment. The Court of Appeals reversed a grant summary judgment for the Defendant. See Doe v. Briargate Apartments, Inc., 227 Ga. App. 408 (1997)
